O R D E R

The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 303(2) and 326(a) of BNS, 2023 in Crime No.251 of 2025, on the file of the respondent Police, seek anticipatory bail.

2. The case of the prosecution is that the petitioner was found in transportation of 75 kilograms of river sand. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that the petitioner has one previous case. Hence, he opposed for grant of anticipatory bail to the petitioner. 2/4

5. Considering the fact that huge quantity of the river sand has been transported by the petitioner and caused damage to river bed and ecology and the petitioner is having one previous case, this Court is not inclined to grant anticipatory bail to the petitioner.
