ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 303(2), 326 of BNS 2023, in Crime No.592 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that when the respondent police conducted a routine vehicle check, they found that the petitioner had illegally quarried and transported 1⁄4 unit of river sand from the Malattar River by using bullock cart and the same was seized from the petitioner, which led to the registration of the FIR. Hence, the present case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and has not committed any such offence as alleged by the prosecution, and that he has been falsely implicated in this case. Hence, he prayed for grant of anticipatory bail.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police reiterated the prosecution case and vehemently opposed the grant of anticipatory bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. Considering the nature and gravity of the offence, and the fact that the petitioner had illegally quarried and transported 1⁄4 unit of river sand, 2/4

thereby causing damage to the ecology, I am not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, this Criminal Original Petition stands dismissed. 1.
