ORDER
The petitioner/A2, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 4 (1)(i), 4(1) (A), 14A of TN Prohibition Amendment Act, 2024 in Crime No. 150 of 2025 on the file of the respondent police, seeks anticipatory bail. 2.The allegation against the petitioner is that on 03.08.2025 at 08.30 am when the respondent police were on patrol duty, the petitioner along with other accused was found in possession of 20 x 180 ml labeled Voriyan Brandy bottles for sale at Eraiyur Palayam Village and the respondent police arrested one of the co-accused and seized the 20 x 180 ml brandy bottles. Hence the case.
3. The learned Counsel for the petitioner submits that the petitioner has been falsely implicated in this case and the petitioner has not committed any offence as alleged by the prosecution. He further
submits that the petitioner is ready to abide by any condition imposed by this Court and he prays to grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and reported that the petitioner is ranked as A2 in this case. He further submits that the petitioner was found in possession of 25 x 180 ml for sale at Eraiyur Palayam Village and the respondent police arrested one of the co-accused and seized the 20 x 180 ml brandy bottles and the petitioner is having 14 previous cases. He opposed for grant of anticipatory bail to the petitioner. 5.Considering the gravity of offence committed by the petitioner; that the petitioner is having 14 previous cases; if the anticipatory bail is granted to the petitioner he will indulge in similar offences in future, this Court is not inclined to grant anticipatory bail to the petitioner.
