ORDER

This application has been filed by the applicant to grant leave to sue in respect of the subject Suit property before this Court.

2. According to the applicant, he filed the main Suit for the relief of declaration and cause of action arose within the jurisdiction of this Court. However the subject property is situated outside the jurisdiction of this Court, this application has been filed.

3. This Court heard the applicant's side and perused the entire materials available on record.

4. On perusal of plaint and records, it is observed that the substantial part of cause of action arose within the jurisdiction of this Court and the property is situated outside the jurisdiction of this Court and considering the facts and circumstances of the case, this petition is allowed. Leave is granted.

5. The Registry is directed to number the Suit, if it is otherwise in order.
