COMMON ORDER The petitioners, who apprehends arrest for the alleged offence punishable under Sections 303(2) of BNS Act r/w 21(1) of MM Act, in Crime No.335 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The allegation against these petitioners is that, these petitioners illegally quarrying and transporting 36 Metric tons of sand (ghh; kz;) in two tipper lorries and on seeing the Competent Officers the petitioners stopped the vehicle and ran away from there. Hence this case.

3. The learned counsel appearing for petitioners submitted that the petitioners have not committed any offence as alleged by the prosecution, and they have been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4. The learned Government Advocate (Crl. Side) appearing for respondent would submit that the petitioners illegally quarried the 36 Metric tons of sand (ghh; kz;) in two tipper lorries without valid permission, investigation is pending in this case. Hence, he opposed to grant anticipatory bail to the petitioners. 2/4

5. Considering the facts and circumstances of this case, this petitioners is illegally quarried 36 Metric tons of sand (ghh; kz;) in two tipper lorries and also damaged the ecology and, if the anticipatory bail is granted, he will indulge in similar activities, hence this Court is not inclined to grant anticipatory bail to the petitioners with certain conditions.
