ORDER
The only issue surviving for considering is the quantum of mesne profits payable to the respondents. After hearing the learned counsel for the parties and also taking into account the trajectory of the case, and the fact that the petitioner had been enjoying the property since 2010 without paying any payments to the respondents and had only handed over vacant possession to the respondent in
March 2024, I am inclined to modify the order of the Trial Court in the manner following:
1. The petitioner shall pay mesne profit for the period from 12.04.2010 to December 2020, at the rate determined by the Trial Court.
2. From January 2021 till March 2024 (the date of handing over the vacant possession) shall be paid at the rate of Rs.5,000/- per month.
3. The total amount due shall be paid in four equal installments, each scheduled three weeks apart. It is made clear that if a default is committed in even a single installment, it is open to the respondent to execute the order.
2. In result, the Civil Revision Petition stands allowed-in-part in the above terms. No costs. Consequently, connected Miscellaneous Petition is closed.
