O R D E R
This Writ petition has been filed seeking a direction to the second and third respondents to disburse the balance DCRG amount of Rs.2,00,000/- along with interest.
2.Heard the learned counsel appearing on either side and perused the materials available on record.
3.The petitioner was appointed as an Assistant Surgeon on 22.12.1984 and, after promotion to the post of Civil Surgeon and Superintendent-cum-Chief Civil Surgeon, retired from service on attaining the age of superannuation on 30.04.2011. The petitioner is entitled to DCRG benefits amounting to Rs.10,00,000/-. However, he was paid only Rs.8,00,000/- and the balance amount of Rs.2,00,000/- was withheld by the respondents on the ground of "subject to audit objection'. During the audit inspection conducted on 01.04.2010, it was noticed that a challan for a sum of Rs.2,250/- was not found in the records. The said challan was required
to be produced by the subordinate staff, and the petitioner had no personal role or responsibility in the preparation or submission of the said challan. 4.However, citing the said audit objection, the DCRG amount of Rs.2,00,000/- was withheld. Subsequently, the petitioner remitted a sum of Rs.2,250/- and a challan was issued. On submission of the challan, the second respondent, by communication dated 27.08.2024, directed the third respondent to release the balance DCRG amount of Rs.2,00,000/- to the petitioner. Despite such direction, the third respondent failed to take any action to disburse the balance amount of Rs.2,00,000/-. 5.In view of the above, the second and third respondents are directed to disburse the balance DCRG amount of Rs.2,00,000/- to the petitioner, along with interest at the rate of 6% per annum, from the date of his retirement till the date of actual disbursement, within a period of four weeks from the date of receipt of a copy of this order. 6.With the above direction, this Writ Petition stands disposed of. No costs.
