ORDER

The petitioner, who was arrested and remanded to judicial custody on 11.10.2025, for the alleged offence punishable under Sections 204, 319(2) of BNS, in Crime No.249 of 2025, on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that the petitioner joining hands with other accused followed the defacto complainant and prevented him by claiming himself as police party and snatched away a cash bag containing a sum of Rs.55 lakhs from the defacto complainant. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is ranked as A2 and he is in custody from 11.10.2025 and he has not having any previous case. He further submitted that the co-accused/A3 is granted bail before the Sessions Court. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that there are 2/5

totally 11 accused in this case. He further submitted that the accused A1 to A7 have been arrested, and only a sum of Rs. 7 lakhs has been recovered so far. From the petitioner, a sum of Rs. 1 lakh was recovered. He also submitted that the investigation is still pending. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. I have also gone through the records and connected FIR. This petitioner posing himself as a police party intercepted the defacto complainant and snatched a bag containing cash of Rs.55 lakhs. Further, during the course of investigation, a sum of Rs.1 lakh only recovered from this petitioner and that the investigation is pending.

7. Considering the above facts and circumstances of the case, the submissions made by the learned counsel on either side, this Court is not inclined to grant bail to the petitioner.
