The petitioner, who was arrested and remanded to judicial custody on 21.05.2025, for the alleged offence punishable under Sections 191(2), 191(3), 329(4), 296(b), 115(2), 118(1), 109(1), 309(5), 351(3), 61(2) of BNS, in Crime No.348 of 2025, on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that he, along with the other accused, demanded money from the defacto complainant. Since the defacto complainant and his father did not pay the amount, the petitioner allegedly attacked the deceased with a knife, causing severe head injuries, and thereafter assaulted three other persons, also causing serious injuries to them. Hence, the complaint was lodged and the petitioner was arrested.

3. The learned counsel appearing for the petitioner submitted the petitioner was earlier arrested and detained under Act 14 of 1982 and subsequently, the detention order was quashed. He further submitted that the co-accused was released on bail. Hence, he prayed that bail may be granted to the petitioner.

police reiterated the prosecution case and submitted that the petitioner is ranked as A2. He further submitted that the investigation is completed and final report filed and that the injured discharged from the hospital. He further submitted that the petitioner is the main accused having 12 previous cases similar in nature. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

On perusal of the records, it is seen that the co-accused was released on bail in Crl.OP.Nos.16200 & 31335 of 2025 dated 30.06.2025 & 17.11.2025, and that this petitioner is having 12 previous cases, similar in nature and also the submissions made by the learned counsel on either side, this Court is not inclined to grant bail to the petitioner.
