ORDER

The petitioner seeks for a direction, directing the respondents 2 and 3 to reconvey the land in S.No.16/1 situated at Puliyur Village, Akarabad, Kodambakkam, Chennai due to non utilisation of the lands despite lapse of more than 26 years, based on the petitioner's representation dated 17.03.2025.

2. It is the case of the petitioner that subject land originally belonged to one Kalayasundrapathar. After his demise, his wife and petitioner's mother Anjammal and the petitioner as his daughter namely Jothi @ Jothilakshmi jointly inherited the same and have been in possession and enjoyment over the same. The petitioner's mother Anjammal subsequently expired and the petitioner became the sole owner of the said lands. The said lands were acquired by the Tamil Nadu Housing Board by way of notification dated 22.08.1984 and the compensation amount is also deposited before the competent court. Since, the land is not utilised by the Government, the petitioner seeks for reconveyance of the land. In this regard, he has given a representation to the respondents, however, no action is forthcoming. Hence, seeks for a direction. 2 / 4

3. The learned counsel for the respondents 2 and 3 submitted that possession is already taken and the amount is also deposited before civil court, at any event, they consider the representation of the petitioner and pass orders on merits.

4. Heard both sides and perused the materials placed on record.

5. Considering the limited relief sought for in this writ petition, this Court without going into the merits of the case directs the respondents to consider the representations of the petitioner dated 17.03.2025 and pass appropriate order on merits and in accordance with law within a period of two months from the date of receipt of a copy of this order.
