2. The learned counsel for the petitioner would submit that the delay occurred due to the death of the sole petitioner/ appellant and to bring his legal heirs on record.

3. Considering the submission and being satisfied with the reasons assigned in the affidavit, we are inclined to allow this petition.

4. Accordingly, this petition is ordered and the delay is condoned.
