ORDER

When the matter is taken up for hearing, learned counsel for the petitioner and learned counsel for the second respondent are present. The first respondent appeared in person.

2. The first respondent submits that as on date, the Presiding Officer of the Court is transferred and so she has no objection to proceed with the trial in the same Court where the case is pending.

3. Learned counsel for the petitioner and the learned counsel for the second respondent also have no objection to proceed with the trial in the same court.

4. It is brought to the knowledge of this court that due to pendency of the above revision, the cross examination of P.W.1 was closed by the trial Court and therefore, the parties could not cross examine P.W.1.

5. Considering the facts and circumstances of the case, this Court is inclined to 2/4

dispose of the civil revision petition as the parties are ready to proceed with the trial in the same Court. The closure of evidence of P.W.1 and the evidence of the defendants are hereby re-opened. The trial court is directed to give opportunity to both the respondents to cross examine P.W.1 in the manner known to law.

6. The first respondent seeks time limit to dispose of the case. Considering the pendency of the case, the trial Court/Principal Court is directed to dispose of Tr.O.P.No.75 of 2025 on merits and in accordance with law, within a period of four months from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition is closed.
