ORDER

This application is filed to condone the delay of 96 days in filing the written statement and the Counter Claim.

2. According to the applicants they are the defendants in the main suit and they have filed the suit for partition and separate possession as against the plaintiff. After receiving the summons there is a delay in collecting the details thereby, they are unable to instruct the learned Counsel for filing the written statements, hence there is a delay of 96 days. Therefore, filed this application.

3. The respondent have not filed counter.

4. Considering the reasons stated in the affidavit filed by the applicant and to give a fair chance to the applicant to defend the case it is appropriate to allow the application and the delay of 96 days is condoned. The written statement and the counter claim is taken on file. Post the matter on 21.01.2026.
