This petition has been filed seeking to condone the delay of 309 days in filing the Civil Miscellaneous Appeal.

Ms.Madhumitha Kesavan, learned counsel who appeared on behalf of the third respondent, stated that she has no objection to this petition being allowed.

Though notice has been served on respondents 1 and 2 and their names are printed in the cause list, there is no representation for them.

The reasons adduced in the affidavit filed in support of this petition being satisfactory, this Civil Miscellaneous Petition is ordered and consequently, the delay of 309 days in filing the appeal is condoned, subject to the condition that the claimants/petitioners will not be entitled to interest for the delay period i.e., for 309 days, in the appeal.
