The present Criminal Original Petition has been filed seeking to extend the time granted to comply with the order passed by the learned Principal Sessions Judge, Erode, in Crl.M.P.No.1 of 2025 in C.A.No.147 of 2025, dated 05.08.2025.

The submissions of the learned counsel for the petitioner are as follows:- 2.1. The complaint under Section 138 of the Negotiable Instruments Act was filed by the respondent/complainant against the petitioner/accused before the learned Judicial Magistrate, FTC - I, Erode, in S.T.C.No.92 of 2023.

2.2. On 26.06.2025, the trial Court found the petitioner/accused guilty, convicted her and sentenced her to undergo three months simple imprisonment and further directed her to pay the cheque amount of Rs.3,50,000/- as compensation, in default to undergo one month simple imprisonment.

2.3. Against the said judgment, the petitioner preferred an appeal in C.A.No.147 of 2025 along with a petition in Crl.M.P.No.1 of 2025 seeking suspension of sentence. On 05.08.2025, the learned Principal Sessions Judge, Erode, while suspending the sentence imposed on the petitioner, directed her to deposit a sum of Rs.70,000/- before the trial Court within sixty days from the date of the said order. 2.4. Since the petitioner's husband is suffering from various ailments and is also taking treatment in hospital, the petitioner is unable to mobilize the amount. Hence, the present petition has been filed seeking 2/4

extension of time.

Having heard the learned counsel appearing for the petitioner and perused the materials available on record and taking note of the submissions made, this Court is inclined to extend the time granted to the petitioner to comply with the condition imposed by the learned Principal Sessions Judge, Erode, by a month's time.

Accordingly, this Criminal Original Petition stands allowed. The time for depositing the sum of Rs.70,000/- before the trial Court, as directed by the learned Principal Sessions Judge, Erode, in Crl.M.P.No.1 of 2025 in C.A.No.147 of 2025 vide order dated 05.08.2025, is hereby extended by a further period one month from today. 25.11.2025 ham Note: Issue order copy today (25.11.2025) To 1.
