ORDER

This Writ Petition has been filed to direct the second respondent to refund the sum of Rs.84,00,100/- (Rupees Eighty-Four Lakhs and One Hundred only) paid towards Stamp Duty and the sum of Rs.24,00,100/- (Rupees TwentyFour Lakhs and One Hundred only) paid towards Registration Fees, in respect of the un-registered Pending Document No. P-385/2024, within a stipulated time

The learned counsel for the petitioner would submit that initially the petitioner has presented the sale deed on 30.09.2024 for registration before the third respondent by paying the stamp duty of Rs.84,00,100/- (Rupees EightyFour Lakhs and One Hundred only) and the registration fee of Rs.24,00,100/-

(Rupees Twenty-Four Lakhs and One Hundred only). However, the same has been kept pending in Pending Document No.385/2024 citing the reason that some of the documents like patta etc., are not produced along with the documents presented for registration. The learned counsel for the petitioner further submitted that the petitioner is ready to take back the document and hence, seeks a direction to the second respondent to refund the stamp duty and the registration fee paid at the time of presentation of the document for registration. Hence, this Writ Petition.

Mr.T.Gowthaman, learned Additional Advocate General assisted by Mr.M.Roshan Atiq, learned Government's Counsel and Mr.B.Pachaiyappan, learned Government's Counsel for respondents 1 to 5 fairly submitted that in the event of the petitioner takes back the pending document, the respondent authority is ready to return back the stamp duty and the registration fee within a period of eight weeks.

4. Heard the learned counsel on either side and perused the materials available on record.

5. Considering the limited relief sought by the learned counsel for the petitioner and also considering the submission of the learned Additional Advocate General appearing for the respondents 1 to 5, the petitioner is directed

to make a request forthwith to the second respondent for refund of the stamp duty and the registration fee paid in the pending document bearing P.No.385/2024 and on such request being made, the second respondent is directed to return the document and refund the entire stamp duty and registration fee to the petitioner within a period of eight weeks from the date of receipt of such request from the petitioner.

6. With the above direction, this writ petition stands disposed of. No costs.
