: Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue Writ of Mandamus, directing the respondents to take up the representation of the petitioner, to the first respondent and the second respondent on 22.08.2025 and 03.09.2025 respectively, for the encashment of the earned leave and leave on private affairs in the credit of the petitioner and to disburse those benefits to him, within a stipulated time frame. ORDER

The writ petition has been filed for a direction directing the respondents to consider the representations submitted by the petitioner seeking sanction of encashment of earned leave and leave on private affairs and disburse the same.

2. The petitioner was retired from the post of Joint Commissioner of Hindu Religious and Charitable Endowments Department on 30.09.2024 due to his attainment of age of superannuation. However, the petitioner was not disbursed so far in respect of the encashment of the earned leave and leave on private affairs. As per Rule 86 of the Fundamental Rules of the Government of Tamil Nadu read with G.O.(MS) No.315 Finance (T and A-III) Department dated 09.10.2019, the second respondent itself can sanction the encashment of earned leave and leave on private affairs to the petitioner immediately after the date of retirement. However, the second respondent sent a letter to the first respondent dated 17.03.2025 seeking disbursement of encashment of the earned leave and leave on private affairs. Further, the Government Order says that the Head of the Department concerned will send the service particulars of the self Drawing Officers of that department periodically to the first respondent and the first respondent in turn will issue Leave

Eligibility Report of each of the Self Drawing Officer to the Head of the Department on the eve of their retirement based on the accumulated data with them. Accordingly, leave eligibility report of the first respondent, encashment of earned leave and leave on private affairs were sanctioned by the Head of the departments.

In view of the above, the second respondent is directed to disburse the encashment of the earned leave and leave on private affairs to the petitioner, within a period of four weeks from the date of receipt of a copy of this order. Insofar as the terminal benefits and other attendant benefits are concerned, the second respondent is directed to pass appropriate orders, within a period of eight weeks from the date of receipt of a copy of this order.

4. With the above directions, the writ petition stands disposed of. No costs. 26.11.2025 Speaking (or) Non Speaking Order mrn
