This Criminal Original Petition has been filed seeking to set aside and extend the time for the petitioner to surrender before the Court concerned.

Heard the learned counsel appearing on both sides and perused the materials available on record.

The brief facts of the case are as follows:- 3.1. The petitioner is arrayed as an accused in Crime No.2745 of 2020, registered on the file of the respondent for the offences under Sections 341 and 397 of IPC r/w 120(B) of IPC and the petitioner was remanded to judicial custody.

3.2. Thereafter, vide order dated 08.06.2021, in Crl.M.P.No.916 of 2021, the petitioner was granted bail on the condition of executing his own bond and was directed to surrender before the learned Judicial Magistrate, Sriperumbudur, within 15 days from the date of lifting of lock down and to execute a fresh bond with two sureties. 3.3. Due to the petitioner's penurious condition, he was unable to comply with the order within the stipulated period. Therefore, he filed a petition in Crl.M.P.No.2100 of 2025 seeking extension of time to surrender before the Court concerned. However, the learned Principal District and Sessions Judge, Kancheepuram, dismissed the same vide order dated 04.11.2025. Challenging the said order, the present petition has been filed.

Considering the facts and circumstances of the case and taking note of the submissions made by the learned counsel for the petitioner, this Court is inclined to allow this petition.

Accordingly, the Criminal Original Petition stands allowed. The order passed by the learned Principal District and Sessions Judge, Kancheepuram, in Crl.M.P.No.2100 of 2025, on 04.11.2025, is hereby set aside. The petitioner is directed to surrender before the Court concerned within a period of two weeks from the date of receipt of a copy of this order.
