The petitioner, who was arrested and remanded to judicial custody on 04.11.2025, for the alleged offence punishable under Sections 333, 296(b), 115(2), 351(3) and 109(1) of BNS. 2023 and Section 3 of Tamilnadu Public Property (Prevention of Damage & loss) Act, 1992 in Crime No.319 of 2025, on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that he quarrelled with a petty shop owner, damaged the property, and assaulted him with a knife, causing simple injuries. Based on the complaint lodged, the petitioner was arrested.

3. The learned counsel appearing for the petitioner submitted that the injuries sustained by the defacto complainant are only simple in nature and that he was treated as an outpatient. He further submitted that the complaint has been exaggerated as though the petitioner had attempted to commit murder. He also submitted that the petitioner has three previous cases, but all of them pertain to old cases. Hence, he prayed that bail may be granted to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner has three 2/5

previous cases and that the injured was discharged from the hospital on 04.11.2025.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. On perusal of the connected records, it is seen that the petitioner already has three previous cases, including two other cases under Section 307 of BNS. At this stage, if he is released on bail, there is a likelihood that he may involve himself in similar activities.

7. Considering the submissions made by the learned counsel on either side, the nature of the allegations and the fact that the petitioner has three previous cases against him, This Court is not inclined to grant bail to the petitioner.

8. Accordingly, this Criminal Original Petition is dismissed. 19.11.2025 drl 3/5
