ORDER

The petitioner, who apprehends arrest for the alleged offence punishable under Sections 303(2) of BNS Act r/w 21(1) of MM Act, in Crime No.582 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The allegation against this petitioner is that, this petitioner illegally quarrying and transporting 75 kgs of river sand. Hence this case.

3. The learned counsel appearing for petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution, and she has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4. The learned Government Advocate (Crl. Side) appearing for respondent would submit that the petitioner illegally quarried the 75 kgs of river sand without valid permission, the petitioner is not having any previous case. Hence, she opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of this case, this petitioner is 2/4

not only illegally quarried 75 kgs of river sand, but also involved in damaging ecology and waterbody, if the anticipatory bail is granted to the petitioner she will indulge in similar activities, and this Court is not inclined to grant anticipatory bail to the petitioner with certain conditions.
