ORDER

The petitioners, who apprehends arrest for the alleged offence punishable under Sections 326(a), 303(2) of BNS Act, in Crime No.323 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The allegation against this petitioners is that, this petitioners illegally quarried and transported 1⁄4 unit of river sand. Hence this case.

3. The learned counsel appearing for petitioners submitted that the petitioners have not committed any offence as alleged by the prosecution, and they have been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4. The learned Government Advocate (Crl. Side) appearing for respondent would submit that the petitioners illegally quarried the 1⁄4 river unit of sand without valid permission, the petitioners are having one any previous case. Hence, she opposed to grant anticipatory bail to the petitioners. 2/4

Considering the facts and circumstances of this case, this petitioners are illegally quarried 1⁄4 unit of river sand, and also involved in causing damage to ecology and also riverbed, if the anticipatory bail is granted to the petitioners they will indulge in similar activities, and this Court is not inclined to grant anticipatory bail to the petitioners with certain conditions.
