ORDER
This writ petition has been filed challenging the charge memo dated 14.08.2025 and the rejection order dated 23.10.2025 thereby rejecting the request made by the petitioner to reinstate him into service and to keep in abeyance the departmental action till the disposal of the criminal case. 2.
The petitioner was suspended from service on 26.03.2021, when he was serving as Sub Inspector of Police, in pursuant to the registration of FIR in Crime No.04/AC/2021/TVL on the file of the Inspector of Police, Vigilance and Anti-Corruption for the offences under Section 7 of the Prevention of Corruption (Amendment) Act, 2018, alleging that the petitioner received a sum of Rs.20,000/- as bribe. Further he was caught red handedly and arrested and remanded to judicial custody. Now the investigation has been completed and filed final report and the same has been taken cognizance in C.C.No.27 of 2025 on the file of the District Court, Tiruvallur and it is pending for trial.

Now the petitioner was served with charge memo dated 14.08.2025 to initiate disciplinary proceedings. Therefore, the petitioner submitted representation before the first respondent to revoke the order of
suspension and also defer the departmental proceedings till the completion of the criminal proceeding. Since the same was rejected, the petitioner filed the present Writ Petition.

Heard, the learned counsel appearing appearing on either side and perused the materials placed before this Court. 5.
Admittedly the petitioner was served with charge memo on the allegation of receipt of bribe of Rs.20,000/- on 25.03.2021 and the FIR has also been registered as against him on the very same set of allegations. Therefore, the charges are one and the same in the criminal case as well as the departmental proceedings. Further the departmental proceedings will be determined by relying upon the documents and evidences as that of the criminal case.

Considering the above facts and circumstances, the respondents are directed to defer the disciplinary proceedings for the period of six months from today. The trial Court viz., the learned District Judge, Tiruvallur, is directed to complete the trial within a period of six months in C.C.No.27 of 2025. The petitioner is also directed to co-operate with the trial before the
trial Court. It is also made clear that, if the trial is not completed within the period of six months, the respondents are at liberty to proceed with the disciplinary proceedings in the manner known to law. 7.
With the above directions, the Writ Petition stands disposed of. Consequently, connected miscellaneous petitions are closed. There shall be no order as to costs.
