O R D E R

The Criminal Original Petition in Crl.O.P.No.26810 of 2025 was filed to set aside the condition imposed on the petitioner by the learned Principal District and Sessions Judge, Chennai that the petitioner herein is directed to deposit 20% of the compensation amount before the trial Court to the credit of S.T.C.No.1963 of 2023 within a period of four weeks by 1/5

order passed in Crl.M.P.No.1 of 2025 in Crl.A.No.1000 of 2025 in S.T.C.No.1963 of 2023 on the file of the learned Principal District and Sessions Judge, Chennai.

2. The said Crl.O.P.No.26810 of 2025 was disposed of by this Court vide order dated 06.10.2025, the relevant portion of which is as under.

" 6. In view of the above, this Court is of the opinion that merely on the basis of the submissions made by the petitioner, the order of the appellate Court cannot be quashed. However, considering the nature of the complaint filed and the cross examination of the respondent, this Court is inclined to modify the condition imposed by the Appellate Court in CrlM.P.No.1 of 2025 in C.A.No.1000 of 2025 dated 20.08.2025 and the direction to deposit 20% of the compensation amount is hereby reduced to 10%.

7. Accordingly, the petitioner is directed to deposit 10% of the compensation amount before the trial Court within a period of two weeks from the date of receipt of a copy of this order. The appellate Court shall dispose of the appeal on its own merits and in accordance with law.

3. Now, the instant Criminal Miscellaneous Petition has been filed seeking to extend the time for the petitioner to deposit the 10% compensation amount before the trial Court on the ground that the petitioner could not comply with the order dated 06.10.2025 in time.

4. Satisfied with the reasons stated in this petition, time granted in order dated 06.10.2025 is extended by a further period of one week from the date of receipt of a copy of this order.

5. This Criminal Miscellaneous Petition stands ordered accordingly.
