The Writ Petition is filed under Article 226 of the Constitution of India for the issuance of a Writ of Mandamus directing the 3rd respondent to conduct an enquiry on the representation dated 09.10.2025 given by the petitioner for cancellation of Patta No.1726 standing in the name of the 5th Respondent herein for an extent of 1.27 acres of land, instead of 45 cents, comprised in Survey No.128/5 Valaiyamadevi Village, Attur Taluk, Salem District, and issue a separate patta to the petitioner to an extent of 82 cents out of 1.27 acres of land after sub-division within a reasonable time, as ma be fixed by this Court For Petitioner(s):

ORDER
This Writ Petition has been filed seeking for a direction to the 3rd respondent to pass final orders on the petitioner's representation dated 09.10.2025 seeking for cancellation of the patta standing in the name of the 5th respondent, as the said patta has been issued for a larger extent of land, even though the 5th respondent is entitled only to an extent of 45 cents.
2. The notice sent to the 5th respondent in this Writ Petition has been returned with an endorsement 'refused', which amounts to deemed service. The name of the 5th respondent has also been printed in the cause list today. No
prejudice would be caused to the respondents if the petitioner's representation, as stated supra, is considered on merits and in accordance with law, after hearing the objections from the 5th respondent as well as any other third party whom the 3rd respondent deems it fit to enquire.
3. It is also represented by the learned Government Advocate appearing for the official respondents that the 3rd respondent has already commenced enquiry proceedings based on the representation given by the petitioner seeking for cancellation of the 5th respondent's patta.
4. Since no adverse orders are being passed in this Writ Petition, notice to the 5th respondent is dispensed with. This Court is not expressing any opinion on the merits of the petitioner's representation.
5. For the foregoing reasons, this Writ Petition is disposed of by directing the 3rd respondent to pass final orders on merits and in accordance with law on the petitioner's representation dated 09.10.2025 seeking cancellation of the patta standing in the name of the 5th respondent for the property morefully described in the prayer to the Writ Petition, by restricting the same to an extent of only 45 cents instead of 82 cents, after hearing the objections of the 5th
respondent and any other third party whom the 3rd respondent deems it fit to enquire, within a period of twelve (12) weeks from the date of receipt of a copy of this order. There shall be no order as to costs. 19-01-2026 Index: Yes/No Speaking/Non-speaking order Asi To
