ORDER

This writ petition has been filed seeking for a direction to the respondent to make sub division and issue separate patta for the property, which according to the petitioner is owned by him, based on his online application No.20240216024631 dated 16.02.2024 within a time frame to be fixed by this

Court. 0

2. The petitioner had submitted an application through on-line on 16.02.2024 for the aforesaid purpose. Since the same has not been considered till date, the petitioner has filed this writ petition.

3. Mr. C Jayaprakash, learned Government Advocate, accepts notice on behalf of the respondent.

4. No prejudice will be caused to the respondent if the said authority is directed to survey and demarcate the boundaries of the petitioner's property morefully described in the prayer to this writ petition, after hearing the objections if any from the neighbouring land owners as well as any other party as they deem fit.

5. Since the petitioner has applied for separate patta in his name in respect of his portion of the property, only after the survey and demarcation of the boundaries, the said relief can be granted. Liberty is granted to the petitioner to file separate representation.

6. Accordingly, this writ petition is disposed of in the following manner:- (a) Before surveying the lands in question, the respondent is directed to issue notice to the neighbouring land

owners, and also to any other party, if they deem fit to put on notice;

(b) After receiving objections if any and after considering the same, the respondent shall conduct survey and demarcate the boundaries of the property morefully descried in the prayer to this writ petition, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order;

(c) With regard to the second limb of prayer sought for by the petitioner, i.e. issuance of separate patta in the name of the petitioner is concerned, the petitioner will have to file a separate writ petition, once survey and demarcation of boundaries is completed pursuant to the directions issued by this Court today;

(d) The respondent shall also consider the said application to be submitted by the petitioner, seeking for issuance of separate patta in his name of his portion of the property and pass final orders on the said application as well within a period of eight weeks from the date when the Survey and demarcation has been done.
