PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, pleased to issue a Writ of Mandamus, directing the respondents to delete the field No.652/1A which is having sub division No.652/1A1A1A which belonged to the petitioner and make necessary cancellation entry in the Encumbrance Certificate based on the petitioner's representation dated 24.10.2025.

ORDER

The petitioners assert that a wrong entry was made in the encumbrance certificate in respect of Survey No.652/1A, which is sub divided as Survey No.652/1A1A1A. After submitting representation dated 24.10.2025 seeking rectification of the entries in the encumbrance certificate, the present writ petition has been filed. 2/5

2. Learned counsel for the petitioners relies upon the decision of the Revenue Divisional Officer dated 31.12.2020 accepting the petitioner's contentions.

3. Learned Special Government Pleader accepts notice for both the respondents. He submits that an inquiry would be conducted by providing a reasonable opportunity to the petitioner and Shanmugasundaram before a decision is taken.

4. Accordingly, without expressing any opinion on the merits, this writ petition is disposed of by directing the second respondent to conduct an inquiry in relation to the petitioner's request for rectification after providing a reasonable opportunity to the petitioner and Shanmugasundaram. A speaking order shall be issued within two weeks from the date of receipt of a copy of this order. No costs. Consequently, the connected writ miscellaneous petition is closed.
