ORDER

This Writ Petition has been filed seeking a direction to the respondent to pay difference in pension arrears for the period from 31/08/2015 to 30/09/2019 based on the increased Grade Pay and revised pay as per 12 (3) Settlement dated 04/01/2018 with 10% interest to the petitioner.

2. Heard the learned counsels appearing on either side and perused the materials available on record. With the consent of both sides, the Writ Petition is taken up for hearing at the admission stage itself.

The learned counsel for the petitioner submitted that the petitioner joined as Conductor in the first respondent Corporation on 01.06.1985 and retired from service as Checking Inspector/Time Keeper on 31.07.2015. He continued that the retirement benefits were calculated on the pre-revised pay scale but not based on the increased Grade Pay and revised pay as per 12 (3) Settlement dated 04.01.2018 and hence, there arose difference in disbursement of his pension arrears. He further submitted that as the differential amount has not been disbursed, he made a representation on 04.10.2025 to the respondents to disburse the same with interest, however, there was no response till date and hence, the present Petition for the aforesaid relief. __________Page 2 of 4

4. Per contra, the learned counsel appearing for the respondents fairly admitted the contentions of the petitioner and submitted that there may be a direction to the respondents to disburse the same.

Considering the submissions made by the learned counsels on either side, this Court directs the respondents to pay the differential amount of pension arrears to the petitioner with interest at the rate of 6% p.a. from the date of entitlement to till the date of actual disbursement, if there is no other impediment in disbursing the same, within a period of six weeks from the date of receipt of a copy of this order, taking into account the bank rate of interest on deposits.

6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
