The petitioner, who was arrested and remanded to judicial custody on 30.09.2025, for the offence punishable under Sections 8(c) read with Section 20(b)(ii)(B), 25 and 29(1) of NDPS Act 1985 in Crime No.349 of 2025, registered on the file of the respondent, seeks bail. 1/4
2. The case of the prosecution is that the petitioner along with other accused was found in possession of 1.3 kgs of ganja. Hence, the case.
3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that co-accused has been released on bail. Hence, he prayed for grant of bail to the petitioner.
4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that the petitioner has 5 previous cases. Hence, he opposed for grant of bail to the petitioner.
5. Though, it is seen that, co-accused has been released on bail, considering the bad antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.
6. Accordingly, this Criminal Original Petition is dismissed. 28.11.2025 sma 2/4
