Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the first respondent to consider the representation of given by the petitioner dated 16.06.2025, to take action against the 4 th respondent and to enable the petitioner to reside in the above said property peacefully and pass orders.

ORDER
This writ petition was filed seeking a direction to the first respondent to consider the representation of the petitioner dated 16.06.2025.
2. The petitioner herein is a senior citizen aged 75 years now. She and her husband late Dhandapani had constructed a house at Old No.4/33. New No.17, Amman Nagar, Pappanaickenpalayam, Coimbatore, consisting of ground floor and first floor. The couple had three children, namely two 2/7
daughter and a son. Her husband died in the year 2004. Her son is the fourth respondent herein. After the demise of her husband, the fourth respondent and his family started residing in petitioner's house, but he failed to take care of his aged mother. Therefore, the petitioner had started living with her younger daughter at her husband's house at Vadavalli.
3. Sometime in 2024, the petitioner had decided to stay in her own house and returned back. The petitioner would submit that she was allotted a small room measuring 10"x8" in the ground floor of said property, however she was denied of basic needs. The medical expenses and monetary needs of the petitioner were taken care of by her daughters. The petitioner would submit that the portion where she was permitted to stay by her son, the fourth respondent, is not convenient and suitable to reside. That apart, she was illtreated by her son and her daughter-in-law. Hence, the petitioner gave a petition to the first respondent on 16.06.2025, to take necessary action against the fourth respondent, so as to enable her to reside in the ground floor of the 3/7
property.
4. Based on the complaint, an enquiry was conducted by the third respondent and a report was submitted to the second respondent on 10.09.2025, and thereafter, there was no progress. Hence, the petitioner is before this Court seeking a mandamus to the first respondent to consider her representation.
5. Heard the learned counsel appearing for the petitioner and the learned Special Government Pleader appearing for respondents 1 to 3.

Considering the fact that the petitioner is a widow, aged 75 years now, and has been subjected to physical and mental torture by the fourth respondent in not providing her with the basic amenities and also the portion alloted to her was not convenient and suitable to reside, this Court directs the first respondent to consider the representation of the petitioner dated 16.06.2025 and pass orders within a period of one month from the date of receipt of a copy of this order, 4/7
after affording an opportunity of hearing to the interested parties.
