Anaesthesia respectively based on the qualification and eligibility condition prescribed in Medical Institutions (Qualification of Faculty) Regulations, 2025 by reckoning seniority in the post of Senior Resident / Assistant Professor in teaching cadre on par with juniors with all consequential and other attendant benefits in consideration of representations submitted by the petitioners dated 07.11.2025 & 06.11.2025 respectively within a time frame to be fixed by this Court. 2.
The learned Senior Counsel appearing for the petitioners submitted that the qualification for promotion to the post of Associate Professor is that four years as on Associate Professor in concerned subject in a recognised medical institution or five years for those appointed directly as Assistant Professor in Government medical institution. Further a non-teaching consultant or specialist or medical officer possessing post graduate medical degree with 10 years of experience in at least 220 bedded Government hospital shall be eligible to become 4/8
Associate Professor of that broad specialty and on such appointment, shall be required to undergo Basic Course in Medical Education and Basic Course in Biomedical Research within two years of the appointment The learned Senior Counsel further pointed out that without the said qualification, the respondents are about to permit the person who does not possess PG degree to the post of Associate Professor. 3.
In view of the above, the respondents are directed to promote the qualified persons only to the post of Associate Professor in accordance with the regulations issued by the National Medical Council. 4.
With the above direction, both the writ petitions are disposed of. There shall be no order as to costs.
