ORDER

This petition has been filed to grant extension of time to deposit the amount in court as per order dated 05.04.2024.

2. When the petition is taken up for hearing, the learned counsel appearing for the petitioner would submit that the petitioner is ready to settle the matter, as per the terms of the decree dated 05.04.2024, therefore, prays time for payment.

3. On the other hand, the learned counsel appearing for the respondents would submit that already the respondents have filed a petition for final decree and the same is pending and strongly objected to grant time to the petitioner.

6. Heard the learned counsel on either side and perused the documents placed on record.

7. Since the respondents have filed a petition for final decree, if the petitioner intends to settle the matter, they can very well approach the court where the final decree petition is pending and if any amount is paid by the petitioner / appellant, the court can consider the same and pass appropriate orders on merits. Further, both the parties are at liberty to file calculation memo in the final decree petition so that the court can come to a fair conclusion.
