PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the respondents to consider the petitioners representation dated 23.06.2025 to give annual increment, promotion and service with monetary benefits from the year of reinstated on 19.05.2010 to till date with all consequential benefits and arrears. ORDER

The present writ petition has been filed to direct the respondents to consider the petitioner's representation dated 23.06.2025 to give annual increment, promotion and service with monetary benefits from the year of reinstated on 19.05.2010 to till date with all consequential benefits and arrears.

2. The learned counsel for the petitioner would submit that the petitioner was working as Irrigation Assistant in Pennai River Basin Circle, Thiruvannamalai. It is stated that after completion of two year of service, the respondent had given a complaint against the petitioner in C.C.No.55 of 2010, thereafter the petitioner was not allowed to join duty. Vide order dated 24.10.2012 before the Court of Judicial Magistrate-I, Dharmapuri, it was stated that the petitioner was not found guilty and was set at liberty. While so, the 4th respondent reinstated the petitioner in service and transferred him from Chinnar Dam Division to Arur Basine from 19.05.2010 onwards, however, pursuant to the reinstatement the petitioner has not been given other service or monetary benefits 2/6

till date. Therefore, the petitioner submitted representation to the respondents on 23.06.2025 for annual increment, promotion and service with monetary benefits from the year of reinstatement on 19.05.2010, however, the same has not been considered by the respondents till date. Hence, this writ petition.

Though very many grounds have been raised in this writ petition, learned counsel appearing for the petitioner submits that, it would suffice, if this Court issues a direction to the 2nd respondent to considering the petitioner's representation dated 23.06.2025, within a time frame that may be fixed by this Court.

4. In view of the limited request sought for by the learned counsel appearing for the petitioner, this Court, without expressing any opinion on the merits of the case, directs the 2nd respondent to consider the petitioner's representation dated 23.06.2025, on merits and in accordance with law and pass appropriate orders, within a period of four (4) weeks from the date of receipt of a copy of this order, after affording an opportunity of personal hearing to the petitioner and aggrieved persons, if any.
