This Civil Revision Petition has been filed under Article 227 of the Constitution of India praying to direct the Principal District Judge, at Chengalpattu to conduct the case in O.S.No.188 of 2023 pending on the file of the Principal District Court, Chengalpattu expeditely. For Petitioners :

ORDER

This Civil Revision Petition has been filed by the Petitioners praying to issue direction to the learned Principal District Judge, Chengalpattu to conduct the case in O.S.No.188 of 2023 pending on the file of Principal District Court, Chengalpattu.

2. The learned counsel for Petitioners submitted that the Petitioners had filed an original suit in O.S.No.188 of 2023 before the Principal District Court, Chengalpattu. The Respondents are Defendants in the said suit. The reliefs sought in O.S.No.188 of 2023 are as follows:

(a) Declaration declaring the 1st Plaintiff as absolute owner of the property of an extent of 2,577 Sq.ft bearing Plot No.1 at "Sri Ganapathy Nagar" lay out, more fully described in the suit schedule comprised in Survey No.414/1A1A part of Pallikaranai Village along with the rights of pathways, common passages as shown in the said lay-out map as per the purchase deed dated 07.02.2011 in Doc.No.1474/2011 registered on the file of the Joint I, Sub Registrar, Chennai South at Saidapet.

(b) Declaration declaring the 2nd Plaintiff as absolute owner of the property of an extent of 2,577 Sq.ft bearing Plot No.8 at "Sri Ganapathy Nagar" lay out, more fully described in the Suit Schedule, comprised in Survey No.414/1A1A part of Pallikaranai Village along with the rights of pathways, common passages as shown in the said lay-out map as per the purchase deed dated 07.02.2011 in Doc.No.1480/2011 registered on the file of the Joint I, Sub Registrar, Chennai South at Saidapet.

(c) Declaration declaring the 3rd Plaintiff as absolute owner of the property of an extent of 1,220 Sq.ft., bearing Plot No.7 at "Sri Ganapathy Nagar" lay out, more fully described in the suit schedule, comprised in Survey No.414/1A1A part of Pallikaranai Village along with the rights of pathways, common passages as shown in the said lay-out map as per the purchase deed dated 07.02.2011 in Doc.No.1479/2011 registered on the file of the Joint I, Sub Registrar, Chennai South at Saidapet.

(d) Declaration declaring the 4th Plaintiff as absolute owner of the property of an extent of 2,510 Sq.ft bearing Plot No.5 at "Sri Ganapathy Nagar" lay out, more fully described in the suit schedule, comprised in pathways, common passages as shown in the said lay-out map as per the purchase deed dated 07.02.2011 in Doc.No.1478/2011 registered on the file of the Joint I, Sub Registrar, Chennai South at Saidapet.

(e) Declaration declaring the 5th Plaintiff as absolute owner of the property of an extent of 2,443 sq.ft bearing Plot No.2 at "Sri Ganapathy Nagar" lay out, more fully described in the suit schedule, comprised in Survey No.414/1A1A part of Pallikaranai Villaage along with the rights of pathways, common passages as shown in the said lay-out map as per the purchase deed dated 07.02.2011 in Doc.No.1475/2011 registered on the file of the Joint I, Sub Registrar, Chennai South at Saidapet.

(f) Declaration declaring the 6th Plaintiff as absolute owner of the property of an extent of 2,472 Sq.ft bearing Plot No.6 at "Sri Ganapathy Nagar" lay out, more fully described in the suit schedule, comprised in Survey No.414/1A1A part of Pallikaranai Village along with the rights of pathways, common passages as shown in the said lay-out map as per the purchase deed dated 20.04.2011 in Doc.No.3065/2011 registered on the file of the Joint I, Sub Registrar, Chennai South at Saidapet.

(g) Declaration declaring the 7th Plaintiff as absolute owner of the

property of an extent of 2,433 Sq.ft bearing Plot No.3 at "Sri Ganapathy Nagar" lay out, more fully described in the suit schedule, comprised in Survey No.414/1A1A part of Pallikaranai Village along with the rights of pathways, common passages as shown in the said lay-out map as per the purchase deed dated 07.02.2011 in Doc.No.1476/2011 registered on the file of the Joint I, Sub Registrar, Chennai South at Saidapet.

(h) Declaration declaring the 8th Plaintiff as absolute owner of the property of an extent of 1,220 Sq.ft bearing Plot No.4 at "Sri Ganapathy Nagar" lay out, more fully described in the suit schedule, comprised in Survey No.414/1A1A part of Pallikaranai Village along with the rights of pathways, common passages as shown in the said lay-out map as per the purchase deed dated 07.02.2011 in Doc.No.1477/2011 and Settlement Deed dated 25.05.2018 in Doc.No.5095/2018 registered on the file of the Joint I, Sub Registrar, Chennai South at Saidapet.

(i) Permanent injunction restraining the Defendants 1 & 2 or their men, agents, servants or anybody acting on behalf of them from interfering with the peaceful possession of the Plaintiffs over the suit schedule mentioned property.

(j) Permanent injunction restraining the Defendants 1 & 2 or their men, agents, servants or anybody acting on behalf of them from in any manner encumbering the suit schedule mentioned property. (k) Declaration declaring the Settlement Deed dated 17.07.2006 executed in favour of the 2nd Defendant by his father E.Prancis Manova in Doc.No.5283/2006 registered on the file of the Joint I, Sub Registrar, Chennai South as null & void and not binding on the Plaintiffs.

(l) Declaration declaring the Sale Deed dated 10.10.2007 executed in favour of 1st Defendant by the 2nd Defendant in Doc.No.7221/2007 registered on the file of the Joint I, Sub Registrar, Chennai South as null & void and not binding on the Plaintiffs. (m) Directing the Defendants 1 & 2 to pay cost of the suit to the Plaintiffs."

In the present case, the Respondents/Defendants are not inclined to proceed with the matter and thus, the suit is still pending on the file of Principal District

Court, Chengalpattu. That apart, in this case, 8th Petitioner/8th Plaintiff (Power Agent of Petitioners 1 to 7) is a senior citizen aged above 70 years. Therefore, the learned counsel prayed that appropriate direction may be issued to the Trial Court to expedite the trial and dispose of the suit as early as possible.

3. Heard the learned counsel for Petitioners and perused the materials available on record.

Considering the limited relief sought by the Petitioners, this Court, without going into the merits of the case, directs the learned Principal District Judge, Chengalpattu to expedite the trial and dispose of the suit in O.S.No.188 of 2023, within a period of six months from the date of receipt of a copy of this order.

5. This Civil Revision Petition is disposed of with the above direction. No costs.
