This Civil Miscellaneous Petition has been filed to condone the delay of 199 days in filing the above appeal.
2. Heard the learned counsel for the petitioner.
3. Notice to the sole respondent has been served and returned with the endorsement "refused". Hence, service is deemed sufficient. Despite such service, there is no representation on behalf of the respondent. https://www.mhc.tn.gov.in/judis

The petitioner would aver that, instead of preferring the present Appeal Suit, he had filed a Civil Revision Petition challenging the order passed in I.A.No.2 of 2024 before this Court and that the same was disposed of by order dated 23.10.2025. According to the petitioner, the delay of 199 days in filing the present Appeal Suit occurred on account of the pendency of the said Civil Revision Petition.

Accepting the averments made in the petition, this petition shall stand allowed on payment of cost of Rs.1,000/- payable in favour of the Cancer Institute (WIA), Gandhi Nagar Canal Bank Road, Adyar, Chennai - 20 (payable in S.B.A/c.No.149710011000002, Union Bank of India, Madhya Kailash Branch, Cancer Institute (WIA) Campus, Sardar Patel Road, Chennai-36, Branch Name and Code : 1497, MICR No.600011049, IFSC Code : UBIN0814971), on or before 30.06.2026. Failing which, this petition shall stand automatically dismissed without any further reference to this Court. 17.06.2026 nvi To 1.The Additional District Judge, Krishnagiri.
