2. This Transfer Civil Miscellaneous Petition is filed by the petitioner/wife seeking transfer of H.M.O.P. No.122 of 2023 (divorce petition) pending on the file of the Family Court, Madurai to the Family Court, Salem.

3. The marriage between the petitioner and the respondent was solemnized on 26.11.2020 at APR Thirumana Mahal, Arappalayam, Madurai. The parties have no children. The petitioner is residing at Salem and the respondent/husband filed a petition or divorce in HMOP No.122 of 2023 which is presently in the stage of P.W.1-cross exmination.

4. The petitioner states that attending the Family Court at Madurai from Salem on every hearing causes hardship and also states that M.C. has been 2/5

pending before the Family Court at Salem.

5. Considering the residence of the petitioner at Salem, the pendency of maintenance proceedings at Salem, and the overall facts, this Court is of the view that the ends of justice would be served by ordering transfer of the matrimonial original petition to Salem.

6. Accordingly, Tr.C.M.P. No.1276 of 2025 is allowed. H.M.O.P. No.122 of 2023 on the file of the Family Court, Madurai, is withdrawn and transferred to the file of the Family Court, Salem. The Family Court, Madurai, shall transmit the entire records to the Family Court, Salem, within three (3) weeks from the date of receipt of this order and the Family Court, Salem shall dispose of the matter in accordance with law, as expeditiously as possible, uninfluenced by any observations made in this order. Interim stay granted by this Court on 24.11.2025 shall stand vacated and C.M.P. No.29292 of 2025 is closed. There shall be no order as to costs.
