ORDER

This petition has been filed seeking a direction to the 3rd respondent to consider the petitioner representation dated 13.10.2025 to pay the subsistence allowance to the petitioner at the rate of 75 percentage with effect from 16.6.2024 continuously.

2. It is the case of the petitioner that the petitioner has joined service as Junior Assistant in the year 2002 and he was placed under suspension on 27.12.2013 for the irregularities committed by him. As against the petitioner, two criminal cases are pending and simultaneously, departmental enquiry is also going on. Subsequently, the criminal cases were ended in acquittal. Therefore, the petitioner has made a representation on 13.10.2025 to pay the subsistence allowance to him and the same is not considered. Hence, the present writ petition.

3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass orders on the petitioners representation within the stipulated time as fixed by this Court.

4. The learned Special Government Pleader appearing for the respondent submitted that the representation will be considered and appropriate orders will be passed within the stipulated time as fixed by this Court.

5. Heard the learned counsel for both side and perused the materials available on record.

6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the first respondent to consider and pass orders on the petitioner's representation dated 13.10.2025 and settle the eligible payment of subsistence allowance to the petitioner within a period of four weeks from the date of receipt of a copy of this order.
