This Civil Miscellaneous Petition has been filed to condone the delay of 163 days in filing the above appeal.

2. Heard the learned counsel for the petitioners and the learned counsel for the 2nd respondent.

3. Despite the receipt of notice, none represents the respondent Nos. 3 to 5.

4. The learned counsel for the 2nd respondent has no serious objection to allowing the petition.

5. The petitioners would aver that, due to death of their son, who was the sole breadwinner of their family, they were facing severe financial constraints. Consequently, a delay of 163 days has occurred in filing the Civil Miscellaneous Appeal.

6. Accepting the averments made by the petitioner in the affidavit enclosed with the petition, this Court is inclined to allow this Civil Miscellaneous Petition subject to the condition that the interest for the delay period of 163 days shall stand waived.
