ORDER
This petition has been filed, challenging the impugned order passed by the 2nd respondent dated 30.06.2024 and seeking a direction to the respondents to pay the petitioner's retirement benefits of sum Rs.16,44,625/- along with statutory interest at 12% amounting to Rs.45,420/-, from the date of retirement i.e. 30.06.2024, till the date of actual payment, within the stipulated time as may be fixed by this Honble Court.
2.The case of the petitioner is that he joined as a Salesman in the 3rd respondent Society on 14.10.1987, and retired from service on 30.06.2025, without any remarks or any surcharge order dues. However, his retirement benefits were not settled on the ground of non-payment of surcharge loan. The denial of retirement benefits by the respondents is illegal. The petitioner made a representation to the respondents on 22.09.2025, however, the same has not been considered till date. Hence the present writ petition has been filed. 3.The learned counsel appearing for the petitioner would submit that the surcharge amount has already been settled with the Society and that there are no dues payable to the Society. Hence, there is no legal impediment to the settlement of the petitioner's the terminal benefits.
4. In view of the above, the respondents are directed to verify whether any dues are payable to the Society under the surcharge proceedings. If no dues are found payable, the respondents are directed to settle the petitioner's terminal benefits along with applicable statutory interest within a period of six
(6) weeks from the date of receipt of a copy of this order.
5.With the above directions, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. 04-02-2026 Index: Yes/No Speaking/Non-speaking order UMA
