ORDER
The petitioner was arrested on 27.06.2025, on execution of Non-Bailable 1/9
Warrant issued by the XVII Additional Sessions Court, Chennai, for the offence under Section 395 r/w 397 IPC, pending trial in S.C.No.151 of 2021 in respect of Crime No.507 of 2020 on the file of the respondent police, seeks bail. 2/9

The allegation against the petitioner is that the petitioner in this case was arrested and released and subsequently he was not appeared before the Trial Court, NBW was issued against him on 10.06.2025 and on execution of NBW, the petitioner was arrested and remanded to judicial custody on 27.06.2025.

The learned counsel appearing for the petitioner would submit that the petitioner is an accused facing trial in S.C.No.151 of 2021 pending on the file of the learned XVII Additional Sessions Judge, Chennai. He further submitted that the petitioner due to his illness, was unable to appear before the Court, thereby the learned Magistrate had issued Non Bailable Warrant of arrest on 27.06.2025 and thereby apprehending arrest, the present petition has been filed seeking for anticipatory bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the petitioner is an habitual absconder from the Trial Court and that in the year 2024, also he had similarly absconded after being released on bail. This is the second occasion on which the NBW was executed, and the petitioner has now appeared only after such execution. He further 3/9
submitted that the petitioner has three previous cases pending against him, including one case of murder and another under the NDPS Act. Hence, he opposed to grant bail to the petitioner.
5. Heard both sides and perused the materials available on record.
6. Considering the submissions made by the learned counsel on both sides and also perused the records, it is seen that in the year 2024, the petitioner had jumped bail, was arrested and subsequently released on bail. This is the second time on which he has jumped bail, and once again the petitioner was arrested.
7. Considering the fact that the NBW was executed on 27.06.2025 and the case is posted for the next hearing on 15.12.2025, and the trial is not yet progressed, this Court is inclined to grant bail to the petitioner, subject to the following conditions:

Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties, for a like sum to the satisfaction of the learned XVII Additional Sessions Court, Chennai and on further conditions that:- [a] the sureties shall affix their photographs and Left 4/9
Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;
[b] the petitioner shall report before the concerned Court daily at 10.30 a.m., for a period of three weeks. [c] the petitioner shall not abscond either during investigation or trial;

[d] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];
[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S.
