ORDER

The petitioner, who was arrested and remanded to judicial custody on 11.10.2025, for the offence punishable under Sections 331(4), 305(a) of BNS, 2023, in Crime No.272 of 2025, registered on the file of the respondent, seeks bail.

2. The case of the prosecution is that the petitioner trespassed into the Temple premises and committed theft of Rs.1,035/- and the gold coin weighing 1 gram and other silver articles. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that, petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and opposed for grant of bail to the petitioner. He further submitted that the petitioner has 2 previous cases in his credit, and property is not recovered.

5. Considering the bad antecedents of the petitioner, if the petitioner is granted anticipatory bail he would indulge in similar offences, hence, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed.
