This criminal original petition has been filed to direct the respondent police to add the petitioner as a witness in Cr.No.16 of 2022 on the file of the respondent police in CC No.7 of 2022 on the file of the 1/4

learned Special Judge No.1, TNPID Court, Chennai, based on the complaint of the petitioner by filing supplementary charge sheet before the trial Court.

The learned counsel appearing for the petitioner submitted that the First Information Report in Crime No.16 of 2022 for the offences under Sections 420 and 120B of IPC and 5 of the Tamil Nadu Protection of Interest of Depositors (In Financial Establishment) Act, 1997 and 3, 5, 21(1), 21(2), 21(3), 23 and 25 of the Banning of Unregulated Deposit Schemes Act,2019 (BUDS Act), was registered, on the basis of the complaint given by one Kumar against LNS International Financial Services Limited. It is his further submission that petitioner is one of the investors and had invested to the tune of Rs.28,50,000/-. Subsequently, the respondent has completed the investigation and filed the final report and the case has been taken up in C.C.No.7 of 2022 on the file of the Special Judge No.1, TNPID Court, Chennai. However, her name has not been shown as a witness and hence, she has filed the petition to implead her as a witness in the supplementary charge sheet to be filed before the Court.

3. In response, the learned Government Advocate (Crl.Side) submitted that the respondent has initiated the process for further investigation by filing a memo and the trial Court has permitted the 2/4

respondent to continue with the further investigation. The respondent has served summons on the petitioner for appearance on 06.08.2025, however, she has not appeared for investigation. If the petitioner appears before the respondent for investigation, her statement would be recorded and if necessary, she would be shown as a witness.

4.In the light of the above submissions made by the learned Government Advocate (Crl.Side), since the respondent has already initiated the process for further investigation and the petitioner has also been summoned for giving statement, no further orders are required in this matter.

5.Accordingly, the criminal original petition stands disposed of. 27.11.2025 shl To 1.
