ORDER

The petitioner, who was arrested and remanded to judicial custody on 06.11.2025 for the offences punishable under Sections 77 of JJ Act and Section 24(1) r/w 6 of COTPA in Crime No.625 of 2025 on the file of the respondent police, seeks bail.

The case of the prosecution is that on 06.11.2025, based on a secret information, the respondent police went to the petitioner's shop and found that the petitioner was involved in illegal possession of 25 kilograms of banned tobacco products for the purpose of illegal sales. Hence, this case. 3.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and she is in judicial custody since 06.11.2025; and that the petitioner is ready to abide by any condition that may be imposed by this Court, hence prays to grant bail to the petitioner.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the bail to the petitioner reiterated the prosecution case and submitted that the petitioner has one previous case of 2/4

similar nature registered in Crime No.406 of 2025 on the file of the same respondent police; and that the investigation of this case is pending. 5.

Considering the submissions made, facts and circumstances of the case, the nature of offence, the previous antecedents of the petitioner and taking note of the fact that the investigation of the case is pending, this Court is not inclined to grant bail to the petitioner. 6.

Accordingly, this criminal original petition stands dismissed. 09.12.2025 stn To
