The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 115(2), 118(1) and 351(3) of BNS, 2023 in Crime No.422 of 2025, on the file of the respondent Police, seek anticipatory bail.
2. The allegation against the petitioner is that due to previous enmity, petitioner along with other accused attacked the defacto complainant severely by using stone, due to which defacto complainant sustained injuries. Hence, 2/6
the case.
3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that though injured has been discharged from the hospital, he has been suffered severe injuries. . Hence, she opposed for grant of anticipatory bail to the petitioner.
5. Considering the fact that though the injured has been discharged 3/6
from the hospital, considering the nature of injuries sustained by the victim, this Court is not inclined to grant anticipatory bail to the petitioner.
