ORDER

The writ petition has been filed seeking a directions to the 2 nd respondent, to issue Site Visit Certificate to the Petitioner, enabling them to participate in the e-Tender floated by the 1 st respondent vide e-Short Term Tender Notice No.NIT.34/2025-26/B(C &M) Circle/ Erode/ dated 04.11.2025, by considering the Petitioner's representation dated 13.11.2025.

It is the case of the petitioner that the petitioner firm is a State-Level Class IV Contractor, recognized by the Chief Engineer, PWD, Coimbatore vide Letter dated 02.05.2023 to carry works up to Rs.2 Crores. The first respondent has floated a tender vide e-Short Term Tender Notice No.NIT.34/202526/B(C&M) Circle/Erode/dated 04.11.2025, inviting tenders for two works with regard to the construction of providing additional amenities and renovation of siddha building. The tender required bidders to personally inspect the work site and obtain the Work Site inspection certificate from the concerned Executive Engineer, P.W.D., In compliance to the requirement of this condition, the petitioner had visited the work site in person on 13.11.2025 and had sent a representation to the 2 nd respondent on 13.11.2025 vide e-mail and also through

registered post on 14.11.2025, which the second respondent received on 17.11.2025. However, the 2 nd respondent has not issued the Site Visit Certificate to the petitioner till date. Hence, the petitioner has filed the above said writ petitions.

The learned counsel for the petitioner submitted that the 2 nd respondent being a public authority, who is duty-bound to process the request made by the petitioner within the prescribed time-lines. The last date for submitting the tender through online application is 19.11.2025. Therefore, this Court may direct the 2 nd respondent to issue Site Visit Certificate to the petitioner by today itself.

5. The learned Special Government Pleader submitted that the certificates will be issued to the petitioner by today itself during office hours.

6. Heard the leaned counsel for the petitioner and the learned Special Government Pleader for the respondents and perused the materials available on record.

7. Considering the fact and circumstances of the case and in view of the limited request sought for by the petitioner, this Court directs the 2 nd respondent to issue work Site Visit Certificate to the petitioner by today itself before 5.00 P.M. The petitioner shall collect the same during office hours.
