Respondent(s) PRAYER This Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Mandamus, directing the fourth respondent to issue a Site Visit Certificate to the Petitioner in respect of the e-Tender Notice No.44/CE/ DO2025-26/ dated 03.11.2025 in so far as S.No.7 work is concerned for construction of 24 class rooms, 1 boys toilet and 1 girls toilet in Thiruvalluvar Government Arts College, Rasipuram in Namakkal District and consequently direct the third respondent to accept the Petitioner's Tender Application and to evaluate the same in e-Tender Notice No.44/CE/ DO2025-26 / dated 03.11.2025 in so far as S.No.7 work is concerned.

ORDER

The writ petition has been filed seeking a directions to the fourth respondent to issue a Site Visit Certificate to the Petitioner in respect of the

e-Tender Notice No.44/CE/ DO2025-26/ dated 03.11.2025 in so far as S.No.7 work is concerned for construction of 24 class rooms, 1 boys toilet and 1 girls toilet in Thiruvalluvar Government Arts College, Rasipuram in Namakkal District and consequently direct the third respondent to accept the Petitioner's Tender Application and to evaluate the same in e-Tender Notice No.44/CE/ DO2025-26 / dated 03.11.2025 in so far as S.No.7 work is concerned.

2. It is the case of the petitioner that the petitioner is a Class-1 Civil Contractor and that the petitioner company has completed several contract works successfully throughout the State. The third respondent issued e-Tender notice No.44/CE/ DO2025-26/ dated 03.11.2025 in so far as S.No.7 work is concerned for construction of 24 class rooms, 1 boys toilet and 1 girls toilet in Thiruvalluvar Government Arts College, Rasipuram in Namakkal District. The tender required bidders to personally inspect the work site and obtain the Site Visit Certificate from the fourth respondent, which was a mandatory pre qualification document. Applications for issuance of this certificate should reach the fourth respondent 4 days before the last date of tender.

It is the further case of the petitioner that the petitioner approached the th respondent on 14.11.2025 in person and that on that date the fourth respondent gave a letter dated 14.11.2025 directing the petitioner to take photograph along with the fifth respondent at the site and produce the same before the fourth respondent. The petitioner complied with the said condition and sent an e-mail dated 17.11.2025 at 3.27 p.m. along with the site photographs to the fourth respondent, requesting to issue Site Visit Certificate to the petitioner and the same has not been considered. Hence, the petitioner has filed the above said writ petition.

The learned counsel for the petitioner submitted that the 4 th respondent being a public authority, who is duty-bound to process the request made by the petitioner within the prescribed time-lines. The last date for submitting the tender along with the Site Visit Certificate is 24.11.2025 at 3.00 p.m.. Therefore, this Court may direct the 4 th respondent to issue Site Visit Certificate to the petitioner by today itself.

5. The learned Special Government Pleader submitted that the certificate will be issued to the petitioner on 21.11.2025 before 05.00 p.m.

6. Heard the leaned counsel for the petitioner and the learned Special Government Pleader for the respondents and perused the materials available on record.

7. Considering the fact and circumstances of the case and in view of the limited request sought for by the petitioner, this Court directs the 4 th respondent to issue the Site Visit Certificate to the petitioner by 21.11.2025 before 5.00 P.M. The petitioner shall collect the same during office hours.
