CMP. Nos.29947,29949 and 29952 of 2025 in SA No.1294 of 2013 DR.A.D.MARIA CLETE,J These petitions are taken up together.

The petitioner seeks (i) to condone the delay of 1038 days in filing the petition, (ii) to set aside the abatement caused due to the death of the sole respondent/ Kumarasamy, and (iii) to bring on record the respondents 1 and 2 as the legal heirs of the deceased sole respondent/ Kumarasamy and rank them as proposed respondents in the second appeal.

2.Heard the learned counsel for the appellant and the learned counsel for the respondents who submits that he has got no serious objection in allowing these petitions. 3.Considering the reasons set out in the affidavit, these petitions are allowed.

Registry is directed to carry out necessary amendments in the cause title.
