ORDER
The writ petition has been filed seeking a directions to the 2nd respondent to forthwith conduct the joint site inspection and issue (i) the Worksite Inspection Certificate and (ii) the Working Condition of Plants and Machineries Certificate to the Petitioner, in respect of e-Tender Notice No.35/2025-2026/SDO dated 04.11.2025 for the work relating to Upgradation of Vellimalai-Chinnathirupathi Road Km 25/0 - 27/6 and 29/5 - 32/740 and DPR for realignment in Km 27/6 - 29/5 by considering the Petitioner's representation dated 14.11.2025.
2. It is the case of the petitioner that the petitioner is a Class-1 Civil Contractor and that the petitioner company has completed several contract works successfully throughout the State. The first respondent issued a e-tender Notice No.35/2025-2026/SDO dated 04.11.2025, for the work relating to upgradation of Vellimalai-Chinnathirupathi Road Km 25/0 - 27/6 and 29/5 -32
/740 and DPR for realignment in Km 27/6 - 29/5. As per the tender conditions, the issuance of (I) the Worksite Inspection Certificate and (ii) the Working Condition of Plants & Machineries Certificate by the concerned Divisional Engineer is a mandatory pre-condition for uploading the bid. Applications for issuance of these certificate were to be submitted on or before 17.11.2025 at 5.45 p.m. and the last date for receipt of the said certificates from the Divisional Engineer is 24.11.2025 at 5.45 p.m..

It is the further case of the petitioner that in compliance with the tender requirements, the petitioner inspected the site on 04.11.2025 and, being fully satisfied with the conditions, immediately submitted a formal written representation dated 14.11.2025 requesting the second respondent to appoint a date for the joint inspection and issue the required Worksite Inspection Certificate and the Plant & Machinery Working Condition Certificates. The said representation was physically served at the office of the second respondent on 17.11.2025 and an e-mail was sent to the second respondent on 16.11.2025, requesting to fix a date for joint inspection and to issue (I) the Worksite Inspection Certificate and (ii) the Working Condition of Plants & Machineries Certificate and the same has not been considered. Hence, the petitioner has filed the above said writ petition.
4. The learned counsel for the petitioner submitted that the 2 nd respondent being a public authority, who is duty-bound to process the request made by the petitioner within the prescribed time-lines. The last date for
submitting the bids is 25.11.2025. Therefore, this Court may direct the 2 nd respondent to issue (I) the Worksite Inspection Certificate and (ii) the Working Condition of Plants & Machineries Certificate to the petitioner by today itself.
5. The learned Special Government Pleader submitted that the certificates will be issued to the petitioner on 21.11.2025 before 05.00 p.m..
6. Heard the leaned counsel for the petitioner and the learned Special Government Pleader for the respondents and perused the materials available on record.

Considering the fact and circumstances of the case and in view of the limited request sought for by the petitioner, this Court directs the 2 nd respondent to issue (I) the Worksite Inspection Certificate and (ii) the Working Condition of Plants & Machineries Certificate to the petitioner, after joint inspection of the site, by 21.11.2025 before 5.00 P.M. The petitioner shall collect the same during office hours.
8. With the above directions, the writ petition is disposed. No costs.
