DATED : 03.12.2025

CORAM

THE HONOURABLE JUSTICE K.RAJASEKAR Crl.O.P.No.33105 of 2025 Dhilip @ Prakash ... Petitioner Vs.

State of Tamilnadu rep by The Sub Inspector of Police, Vellore North Police Station, Vellore District.

... Respondent (Cr.No.220 of 2025) PRAYER : Criminal Original Petition filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, to enlarge the petitioner on bail in Crime No.220 of 2025 pending investigation on the file of the respondent police. For Petitioner : Mr.P.Sriram For Respondent : Mr.A.Gopinath Government Advocate (Crl. Side)

O R D E R

The petitioner, who was arrested and remanded to judicial custody on 10.08.2025, for the offences punishable under Section 270, 296(b), 132, 3(1) of BNS Act and 3(1) of TN Public Property (Prevention of Damage and Loss) Act 1992 in Crime No.220 of 2025, registered on the file of the respondent police, seeks bail.

2.The case of the prosecution is that a quarrel arose between the residents of two streets and, when the police intervened to compromise the matter, the petitioner abused the respondent police in filthy language, broke the glass of the police jeep, and thereby caused damage to the tune of Rs.3,500/-. Hence the case.

3. The earlier bail applications of the petitioner were dismissed twice by this Court, vide orders dated 26.09.2025 in Crl.O.P.No.26680 of 2025 and 23.10.2025 in Crl.O.P.No.28758 of 2025, on the following reasons:

"4.Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and opposed the grant of bail to the petitioner on the ground that the petitioner is involved in 12 previous cases, out of which 3 cases have been disposed of and 9 cases are still pending.

5.Heard the learned counsels on either side and perused the materials available on record.

6.Considering the gravity of the offence and bad antecedents, this Court is not inclined to grant bail to the petitioner." 2/4

4.I am of the view that there is no change in circumstances and without any change in circumstances, this Court is not inclined to reconsider the earlier order. Accordingly, this Criminal Original Petition is dismissed. 03.12.2025 mpa To 1.The Sub Inspector of Police, Vellore North Police Station, Vellore District.

2. The Public Prosecutor, High Court of Madras.
