O R D E R
The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 115(2), 118(1) and 351(3) of BNS in Crime No.276 of 2025 on the file of the respondent Police, seeks anticipatory bail.

The case of the prosecution is that on account of property dispute, the petitioner joined hands with other accused picked up a wordy quarrel with the defacto complainant, abused her using filthy language and assaulted her using hands; that thereafter, the petitioner herein poured hot steaming rice water on the complainant, due to which she sustained burn injuries all over her body, which leads to disfigurement of the victim lady/ complainant. Hence, this case.

The learned counsel appearing for the petitioner submitted that on account of property dispute, there arouse a wordy quarrel between the coaccused and the defacto complainant, thereby both parties exchanged heated words; that the petitioner herein has no direct enmity with the complainant and had not poured hot steaming rice water on the complainant as alleged by the prosecution; that a compromise was also effected between the parties and 2/4
the injured discharged from the hospital; and that the petitioner is ready to abide by any conditions that may be imposed by this Court, hence sought for anticipatory bail to the petitioner.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the anticipatory bail to the petitioner reiterated the prosecution case and submitted that there are totally four accused involved in this case and the petitioner is arrayed as A4; that the petitioner is the prime accused, who poured hot steaming rice water on the complainant, due to which the complainant sustained severe burn injuries; that the injured discharged form the hospital; and that the investigation of this case is pending.

Considering the submissions made on both sides, facts and circumstances of this case, gravity of offence, though it is stated that the injured discharged from the hospital, considering the serious burn injuries caused to the defacto complainant and taking note of the fact that the investigation of the case is pending, this Court is not inclined to grant anticipatory bail to the petitioner.
