ORDER
WMP.No.54242 of 2025 has been filed seeking to permit this petition to file a single writ petition. This petition is ordered, on payment of single court fee.
2. This petition has been filed for a direction, directing the 2nd respondent to send the medical records and relevant documents to the 1st respondent in the prescribed format for the approval in light of the petitioners representation dated 30.09.2025 and pass orders in accordance with law and grant approval for Kidney Transplantation from 2nd petitioner to 1st petitioner and to do the transplantation by the 2nd respondent on the priority basis.
3. It is the contention of the petitioner that the second respondent, who is a family friend of the petitioner, is the donor and she is ready to donate kidney for transplantation to the petitioner and the transplantation is to be done in the second respondent hospital. The petitioner has already submitted an application to the respondents with all the relevant materials, however, unless approval is granted by the authorised committee, transplantation cannot be done. Hence, seeks for a direction to the second respondent to send all the medical records to the first respondent for approval.
4. Heard the learned counsel for the petitioner and the learned standing counsel for the first respondent and perused the materials placed on record. Since no adverse order is passed, notice to the second respondent is dispensed with. By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself.
5. Though normally writ petition is not maintainable, considering the nature of relief and the matter involves organ transplantation which require immediate attention, this Court without going into the merits of the case directs the second respondent hospital authorities to forward the necessary documents/records with application to the first respondent with regard to seeking approval from the District Authorised Committee and the first respondent shall pass appropriate order on merits and in accordance with law immediately without any further delay.
